The daughter of Walmart founder Sam Walton spent the final hours of her birthday in jail Friday night after being arrested for drunk driving after declining to submit to a breathalyzer.

While the Texas Highway Patrol charged her with a first offense, records show that this was only her first offense in the state of Texas. The Springdale District Court in Arkansas show that the heiress was also convicted of driving under the influence in 1998. The UK’s The Independent had previously reported on Waltons alcohol fueled crimes noting she had she struck and killed a 50-year-old mother of two with her Porsche, though no charges were ever brought and was pulled over for drunk-driving in 1998 after hitting a gas meter. During that arrest, Walton yelled at her arresting officer “I’m Alice Walton, bitch!” When she was prosecuted, she ended up having to pay a glaringly modest $925 fine.

Ms Walton then moved to Texas and settled on her ranch with no further arrests until now.

Texas Highway Patrol Senior Trooper Gary Rozzell told The Weatherford Democrat that Trooper Jeff Davis stopped Alice Walton on Interstate 20 driving 71 miles per hour in a 55 miles per hour construction zone. She was returning home from a birthday dinner with friends at a Ft. Worth restaurant,” according to a statement released by her attorney Dee J. Kelly.

“Through an investigation at the scene, [Walton] was determined to be intoxicated during a field sobriety test,” Rozzell explained. “We’re going to treat this like anybody else.”

Walton “accepts full responsibility” for the incident and “deeply regrets it,” her attorney said Friday.

Forbes lists Walton as the ninth richest person in the U.S. and the third richest woman in the world with an estimated wealth of $21 billion.
